Shotgun brandished on U. Circle

Early Sunday morning, Charlottesville Police arrested an Inter Fraternity Counsel vice president at his apartment on University Circle on charges of brandishing a firearm at five other University students.

Kevin Dixon was taken into custody and subsequently released on his own recognizance after police reported that he pointed a shotgun at the victims passing by his Raleigh Court Apartments residence on 10 University Circle.

Police reported Dixon was intoxicated when apprehended.

The victims were members of the Theta Delta Chi fraternity who happened to be pursuing vandals when they encountered Dixon, police said. After vandals broke windows at the Theta Delta Chi fraternity house, the students chased them toward University Avenue, ending up near the Raleigh Court apartments.

According to police, as the students rounded the apartment building, they heard the sound of a weapon being racked. At this time they saw Dixon who pointed a long gun at them and said, "Boy where you going? I'll f---ing shoot you."

Some students fled at the sight of the weapon. Others, thinking Dixon only held an air gun, stood their ground, some pulling shirts over their faces for protection, and told him to go ahead and fire, police said.

The students moved on after Dixon did not respond. Police, who were responding to a call from Theta Delta Chi president Ted Wentz regarding the vandalism of his house, coincidentally encountered the victims of Dixon's alleged assault. Police then entered Dixon's apartment and found him and three others.

Dixon was asleep when officers entered, and the weapon, a 12-gauge shotgun, was nearby. The weapon was not loaded.

Charlottesville Police Officer Chris Massarella, who arrested Dixon, said he "smelt of alcohol but was not extremely intoxicated."

Police said Dixon told officers that he "had had a few drinks."

Dixon, who was not available for comment, was not charged in relation to the vandalism incident.

Brandishing a firearm is a misdemeanor offense and is considered an aggravated assault because it puts victims in fear of their lives. Police have not yet established legal ownership of the shotgun.

Other IFC executives were not available for comment. Dixon is the IFC vice president for Membership and member of Sigma Alpha Epsilon fraternity.
